Version v5 · 19 October 2026. Each family reads the body plus the annex of its programme: Academy · Camp.

Courtesy translation. This English version is provided for convenience only. The Spanish version is the official one and prevails in the event of any discrepancy (article 1.5). Ver versión en español

This version does not apply retroactively: registrations already formalised keep the version they accepted.

The body —articles 1 to 12— is common to all programmes. What changes from one programme to another lives in its annex. Each family reads the body plus the annex of its programme. Nothing else.

Body

1. Identification, scope and structure

1.1. The sports programmes these conditions refer to are provided by Echevarri Sports S.L., tax ID (CIF) B16383192, registered office at Urb. Los Naranjos, Fase V, 29600 Marbella (Málaga), contact email info@echevarrisports.com (hereinafter, “Echevarri Sports”).

1.2. These conditions consist of two parts: a) the body (articles 1 to 12), which governs registration, payment, cancellations, participation and liability, and is common to all programmes; and b) the annex of the programme booked, which sets out the calendar, prices, timetables and conditions specific to that programme and that season. The annex forms part of the contract and is the only part rewritten each season.

In the event of any discrepancy between the body and an annex, the annex prevails as regards dates, amounts and conditions specific to the programme, and the body prevails in everything else.

1.3. Programmes covered: the tennis and padel Academy (season from September to June), sports camps, private and semi-private classes, class passes and single classes.

1.4. The information request forms and the facility visit forms do not formalise any contract: they collect contact details and preferences. These conditions come into play when the family reserves a place by paying.

1.5. Language. The Spanish version of these conditions is the official version. If Echevarri Sports publishes a translation, it is provided for the family’s convenience; in the event of any discrepancy the Spanish version prevails, without prejudice to the rights that consumer law grants the consumer.

2. Booking and confirmation of a place

2.1. Registration is made through the Echevarri Sports form. Submitting the form is a request, not a guaranteed place.

2.2. A place is reserved by paying the deposit set out in the programme annex, which is deducted in full from the total price, or by paying in full. A place is confirmed by paying in full: in the Academy, the fee for the chosen plan (monthly, quarterly or annual; once the season has started, the fee for the current month in accordance with I.6); in camps, the total price.

2.3. In programmes that group participants by level or age, allocation is for the Echevarri Sports technical team. The preferences given on the form are preferences, not a commitment to a timetable or group.

2.4. If Echevarri Sports cannot offer the participant any place compatible with their level and availability, the deposit or full payment made is refunded in full.

2.5. Accuracy of data. The family undertakes to provide truthful, complete and up-to-date information about the participant, in particular regarding their physical condition, allergies, illnesses, ongoing treatments, swimming ability and any circumstance relevant to their safety, and to report any changes.

2.6. Waiting list. When a programme is full, the request may be placed on a waiting list. Being on the waiting list does not reserve a place or oblige you to pay; if a place becomes available, Echevarri Sports will tell the family and the place is reserved in accordance with point 2.2.

3. Prices, payment methods, class passes and non-payment

3.1. The prices published in the programme annex for the current season apply. All amounts include VAT at the rate in force at the time.

3.2. The applicable price is the one in force at the time of payment. Echevarri Sports may change its programme prices depending on availability and demand, but never retroactively: full payment definitively fixes the price of that registration, and the reservation or deposit fixes it for as long as the pre-reservation remains valid. A registration with no payment does not reserve a place or a price.

3.3. Payment methods. The payment methods available, their deadlines and the discounts for early payment are those in the annex of each programme. Early-payment discounts are conditional on payment of the full period; if the family leaves before it ends, settlement is made in accordance with point 4.8.

3.4. Reservation and outstanding balance. Where the annex provides for a reservation or deposit, the remaining amount must be paid within the period that annex indicates. If payment is not completed within that period, Echevarri Sports may release the place and offer it to the waiting list; in that case the family loses the reservation, and any amounts paid over and above it are refunded. Releasing a place for non-payment is not a cancellation by Echevarri Sports for the purposes of article 4.

3.5. Class passes and credit balance. Class passes are valid for 12 months from the date of purchase. Echevarri Sports will notify the family by email at least 30 days before expiry. The same rule applies to any credit balance generated under point 4.8. Class passes are not refundable once use has begun, except in the cases in point 4.9.

3.6. Non-payment. Echevarri Sports will first contact the family; if non-payment continues 7 calendar days after the payment link or payment information was sent, access will be suspended until the matter is settled. Suspension does not end the contract or the amounts accrued up to that point.

4. Cancellations, absences, withdrawals and refunds

4.1. Cancellation by the family. The cancellation conditions and deadlines are those in the programme annex. As a general rule:

a) The reservation or deposit is non-refundable, except in the cases in point 4.2 (cancellation by Echevarri Sports) and those expressly provided for in the programme annex —in particular, documented medical grounds—.

b) Amounts paid over and above the reservation are refunded in accordance with the scale in the annex.

c) Voluntary withdrawal once the programme has started gives no right to a refund for days not attended, without prejudice to points 4.6 to 4.9 for season programmes.

4.2. Cancellation by Echevarri Sports. If Echevarri Sports cancels a programme, an edition or a session for a reason attributable to it:

a) In a whole programme or edition: everything paid is refunded in full, including the reservation.

b) In private or semi-private classes: the class is made up or its price refunded, at the family’s choice.

c) In group classes: a make-up is offered in an existing compatible group and, if there is none, Echevarri Sports may set up a new make-up group.

4.3. Absences. Absences give no right to a make-up or to a reduction in price. A make-up will only be offered when the absence is justified, within existing groups of compatible level and timetable and subject to availability.

4.4. Cancellation of private and semi-private classes by the family.

Notice givenCharge
24 hours or moreNo charge
Between 12 and 24 hours50% of the class price
Less than 12 hours100% of the class price

a) How notice is counted. It is counted from receipt of the written notice under point 4.5 until the class start time. Notice received outside Echevarri Sports’ opening hours (8:00 to 22:00) is deemed received at 8:00 the following morning. Example: notice received at 3:00 for a class at 16:00 the same day is deemed received at 8:00, i.e. 8 hours in advance: 100% is charged.

b) No charge applies, whatever the notice, to a cancellation due to documented medical grounds with an official medical certificate or to duly justified force majeure.

c) If the class is paid for with a class pass, the same proportion is deducted from the pass: nothing, half a class or the whole class.

d) In semi-private classes, the class price is the share corresponding to each student.

The court and the coach are reserved exclusively for that class, so late notice does not allow them to be reassigned.

4.5. Any cancellation must be notified in writing to info@echevarrisports.com. The date the email is received is deemed the effective date of cancellation for all purposes.

Points 4.6 to 4.9 apply to the Academy. Camps are governed by points 4.1 to 4.5 and by Annex II.

4.6. Notice. Withdrawal must be notified in writing before the 25th of the month preceding the month in which it is to take effect. If notified later, it takes effect the following month.

Example. A withdrawal notified on 20 November takes effect on 1 December; notified on 26 November, it takes effect on 1 January.

4.7. Monthly plan. With the notice in point 4.6, no additional amount arises.

4.8. Plans with advance payment (quarterly or annual). The family may withdraw at any time with the notice in point 4.6, without penalty. Because the quarterly and annual prices include a discount conditional on advance payment of the full period, early withdrawal is settled as follows:

a) The monthly instalments elapsed up to the date the withdrawal takes effect are settled at the monthly price published in the annex for the programme booked.

b) The difference between the amount paid and the result of paragraph a) is refunded to the family, or credited in full as a credit balance if they prefer.

c) In no case will the family have to pay any additional amount: if the settlement does not leave a difference in their favour, it is deemed settled.

Example. A family that paid the whole season for €720 —equivalent to ten monthly instalments of €80 with the annual discount— and withdraws with effect in February, five monthly instalments having elapsed, settles 5 × €80 = €400 and receives €320.

4.9. Full refund. 100% of the unused amount will be refunded, without loss of the early-payment discount or any penalty, in the event of the participant’s injury or illness proven by a medical certificate, and in the event of a change of residence proven by any means. This point prevails over 4.8.

5. Right of withdrawal

5.1. Academy and camps. Registration for the Academy and for camps contracts a leisure activity with a specific date or period of performance —the season or the week booked—. Under article 103.l) of the consolidated text of the General Law for the Defence of Consumers and Users, the right of withdrawal does not apply to these registrations. Their cancellation is governed by article 4 and by the programme annex.

5.2. Class passes and single, private and semi-private classes. When class passes and single, private or semi-private classes are contracted at a distance, the family has 14 calendar days to withdraw, without having to give a reason and without any penalty. The period runs from the day after payment. It is enough to notify this by any means that leaves a record, for example an email to info@echevarrisports.com stating the participant’s name and the wish to withdraw. The form in Annex IV may also be used, although it is not compulsory. Echevarri Sports will refund all amounts received within 14 calendar days of receiving the notification and using the same payment method, unless the family asks for another.

5.3. Start within the period. If the family expressly asks for the classes to start before the period expires —a request collected in a separate checkbox on the form— and then withdraws, the proportional part of the service already provided up to the date of the notification will be deducted from the refund, calculated at the unit price published in the programme annex. If, at the family’s express request, the service is provided in full within the 14 days, the right of withdrawal is extinguished at that moment.

6. Rules of participation and conduct

6.1. Participants must follow the instructions of the technical staff and monitors at all times and stay within the areas designated for the activity.

6.2. Respect and coexistence. Participants and accompanying persons are expected to show respect towards coaches, monitors, other participants, other users and the facilities. Echevarri Sports applies a zero-tolerance policy towards harassment, violent behaviour and any conduct that compromises the safety or wellbeing of the group.

6.3. Measures. In the event of serious conduct, or conduct repeated after a written warning, that prevents the activity from running normally, Echevarri Sports may adopt the measure proportionate to the conduct and, in particular: a) limit the accompanying person’s access to the court or activity area, keeping the participant’s registration; or b) withdraw the participant from the programme.

A withdrawal decided on this ground is settled in the same way as a voluntary withdrawal, in accordance with points 4.6 to 4.9 and the programme annex, without additional penalty. This does not affect Echevarri Sports’ right to claim damages that are duly proven under point 10.4.

6.4. Procedure. Except in cases of extreme seriousness —physical assault, or conduct that puts the safety of other participants or staff at immediate risk—, Echevarri Sports will tell the family in writing the reason for the measure under consideration, allowing a reasonable period to submit comments before the final decision. The decision will be notified in writing and with reasons. While the matter is being dealt with, Echevarri Sports may provisionally suspend the participant’s attendance; if the measure is finally not adopted, the affected sessions are made up or deducted from the next invoice.

6.5. Photographs and recordings by families. Accompanying persons may photograph or record their own child. Sharing images showing other minor participants is not permitted without their families’ consent. Echevarri Sports may ask for a post that breaches this rule to be removed.

7. Minors: custody, drop-off and pick-up, health, emergencies and child protection

7.1. Scope of custody. Minors are the responsibility of Echevarri Sports during the hours of the activity booked and within the assigned area. Entering and leaving the facilities is the responsibility of parents or guardians.

7.2. Group supervision. Activities take place under group supervision. The family acknowledges that continuous individual supervision is not provided, unless specifically agreed in writing. The technical staff apply the established safety protocols and keep their attention on the group as a whole.

7.3. Drop-off and pick-up. Drop-off and pick-up take place within the hours set for each session. As a general rule, the person who drops the minor off also collects them. If someone else is going to collect the minor, the parent or legal guardian must first leave written authorisation (for example, an email to info@echevarrisports.com or a message to the team); that person must identify themselves with an official document if staff so require. If someone is late, or a person without that authorisation turns up, Echevarri Sports will keep the minor in its care until the relevant authorisation is verified.

If the family wants the minor to leave the facility on their own at the end of the session, they must expressly authorise this in writing. From then on, Echevarri Sports’ custody ends when the session ends.

7.4. Medical information. The family must report any medical condition, allergy, injury or treatment relevant to sport, and any changes. Any medication to be given during the activity will be handed to staff in its original packaging, with written instructions and the corresponding signed authorisation. Concealment, omission or inaccuracy of this information will be taken into account in determining Echevarri Sports’ liability for incidents that could have been avoided with a truthful declaration.

7.5. Suitability of the activity. Echevarri Sports may limit or condition the minor’s participation in certain activities when, in the technical team’s judgement, this is necessary to protect their safety or that of the group.

7.6. Emergency medical assistance. In the event of a medical emergency during the activity, Echevarri Sports will call emergency medical services and contact the parents or guardians as soon as possible. Echevarri Sports will give the medical personnel the relevant medical information previously provided by the family and will act in accordance with the instructions and decisions of the responsible medical team, including, when they consider it necessary, transferring the minor to a medical centre. Medical assessment, decisions and treatment are in all cases for the healthcare professionals involved.

7.7. Child protection (LOPIVI). Echevarri Sports is subject to the obligations of Organic Law 8/2021 on the comprehensive protection of children and adolescents against violence. It has a wellbeing and protection officer or coordinator, and guarantees that all staff in regular contact with minors hold a valid negative certificate from the Central Register of Sex Offenders and Human Trafficking, in all its programmes.

7.8. Families may request information on the protection of the minor and the officer’s contact details by writing to info@echevarrisports.com.

8. Image rights and data protection

8.1. Photographs and recordings may be taken during the activities.

8.2. Their use on social media, communication materials and the Echevarri Sports website requires the express consent of the parent or guardian, which is collected in a separate checkbox, not ticked by default, and which may be withdrawn at any time by writing to info@echevarrisports.com.

8.3. Refusing this consent does not affect in any way the participant’s participation.

8.4. Strictly necessary internal use for organising the activity —group lists, identification of the participant by staff— does not require this consent.

8.5. Data protection. The processing of personal data —controller, purposes, legal basis, retention, recipients, transfers, rights and complaint to the Spanish Data Protection Agency— is governed by the Privacy Policy, available at https://echevarrisports.com/politica-privacidad. Minors’ health data is treated with the utmost confidentiality and only to ensure their safety during the activity.

8.6. Minors’ data is processed with the authorisation of the parent or guardian who makes the request. Commercial and service communications are addressed exclusively to the parent or guardian listed as contact, never directly to the minor.

9. Changes to the service, force majeure and closures

9.1. Coach and court. Echevarri Sports may change the assigned coach or court for organisational reasons, without affecting the price, while maintaining the level of the programme and the length of the sessions.

9.2. Groups and timetables. Echevarri Sports may reorganise groups that do not reach the minimum number of participants set in the annex, offering an equivalent alternative. When Echevarri Sports permanently changes the day or time of a group, it will give as much notice as possible and offer an equivalent alternative timetable. If none of the alternatives is suitable, the family may end the contract and the unused amount will be refunded without loss of the early-payment discount.

9.3. Closures already announced. The facility closure periods set out in the programme annex form part of the calendar contracted: they are known to the family before registering and give rise to no make-up or reduction in price.

9.4. Unforeseen suspensions. Suspensions not set out in the annex —total or partial closure of the facilities decided by their owner, resort exclusivity events, adverse weather, administrative closures, strikes, pandemics or health restrictions, interruptions of essential supplies, natural disasters or acts of authority— will be made up where possible. Echevarri Sports is not liable for damage arising from these causes.

9.5. If an unforeseen suspension continues for more than one week, Echevarri Sports will offer the affected families the choice between a credit balance or a proportional refund of the amount for the sessions not provided.

10. Liability, insurance and third-party facilities

10.1. Civil liability insurance. Echevarri Sports has civil liability insurance for carrying out its activities, on the terms, limits and conditions set out in the policy taken out.

The existence of that insurance does not replace the health cover that applies to each participant nor does it imply automatic cover for any medical, pharmaceutical, hospital or other expense that may arise during the activity.

In the event of an accident or emergency, Echevarri Sports will act in accordance with the established protocol, request any medical assistance required and follow the instructions of the medical personnel involved, informing parents or guardians as soon as possible.

10.2. Sporting risk. Sport carries an inherent risk of injury —knocks, falls, overexertion— that is part of the activity, which the family knows and accepts when registering the participant, without prejudice to Echevarri Sports’ duty of care in supervising the activity and adapting exercises to the participant’s age and level.

10.3. Personal belongings. The participant’s personal belongings —rackets, backpacks, electronic devices, clothing or other items— remain the sole responsibility of their owner. Echevarri Sports is not liable for their loss, damage or theft, except for proven negligence by its staff. We recommend labelling clothing and not bringing valuables.

10.4. Damage caused by the participant. The participant, or their parents or guardians if a minor, is liable for damage caused wilfully or negligently to sports equipment, the facilities or third parties, under the general civil liability regime of the Civil Code. Echevarri Sports may pass on to the family the duly proven cost of repair or replacement.

10.5. Third-party facilities. Activities may take place in facilities belonging to third parties —clubs, hotels and other venues—. The family contracts with Echevarri Sports, which is its sole counterparty and is responsible for providing the activity. Any other service the family contracts directly with the facility owner —accommodation, catering, access to the venue— is governed by that owner’s own conditions.

10.6. Facility owner’s rules. The participant and their family must respect the internal rules on access and use. If, for breach of those rules, the owner withdraws their access, Echevarri Sports will not be able to provide the activity; in that case the registration is settled as a voluntary withdrawal under points 4.6 to 4.9 and the programme annex.

11. Communications, transfer of registration, acceptance and version

11.1. The email address the family gave on registration is the official channel of communication: confirmation, invoices, notices of change and the notifications provided for in these conditions are sent to it. The family must keep it up to date and report any change.

11.2. Registration is personal to the participant. The family may request a change of participant within the same programme and period, subject to availability and to the new participant meeting the age and level requirements. Echevarri Sports may refuse with reasons.

11.3. Acceptance of these conditions by ticking the relevant checkbox during the online registration process, or by handwritten or electronic signature, is fully legally valid under Law 34/2002 of 11 July on information society services and electronic commerce, Regulation (EU) No 910/2014, as amended by Regulation (EU) 2024/1183, and Law 6/2020 regulating certain aspects of electronic trust services.

11.4. Registration implies acceptance of these conditions and of the programme annex in force at the time of registering. The version accepted and the date are recorded and kept associated with the registration.

11.5. Echevarri Sports may update these conditions. Changes do not apply retroactively to registrations already formalised, which are governed by the version accepted at the time.

12. Complaints, applicable law and jurisdiction

12.1. These conditions are interpreted without prejudice to the rights of the consumer under Royal Legislative Decree 1/2007, approving the consolidated text of the General Law for the Defence of Consumers and Users, and any other applicable consumer protection legislation.

12.2. Complaints. Any issue may be sent to info@echevarrisports.com, which will reply as soon as possible. The family may also contact the consumer services of their municipality or autonomous community.

12.3. Applicable law and jurisdiction. Spanish law applies. To resolve any dispute, the parties submit to the Courts of Marbella (Málaga), without prejudice to the jurisdiction that legally corresponds to the consumer.

12.4. Partial invalidity. If any clause of these conditions is declared void or unenforceable, the rest will remain in force, and the affected clause will be replaced by another that respects as far as possible the purpose pursued within what the law allows.

I.2 · Groups and ages

  • Maximum 6 participants per group (tennis and padel); minimum 4 to open it.
  • Groups are organised by playing level and age, in tennis and in padel.
  • Minimum age to take part: 3 years in tennis and 6 years in padel. The adult rate applies from 18 years completed.
  • Children’s groups are reviewed six weeks after the start. If an open group with 4 participants has not reached 5, Echevarri Sports may reorganise it under point 9.2.

  • Private class time slots are not published; availability is checked with the Academy.

I.3 · Reserving a place

No deposit or prior reservation. The place is reserved and confirmed by paying in full the fee for the chosen plan (point 2.2).

I.4 · Fees and payment plans

The price is by class hours per week, regardless of how they are spread across days. VAT included. The 1.5 h rate is for adults only (morning rate).

I.5 · The fee is monthly, not per session

The season price is paid in ten monthly instalments, or in the equivalent quarterly or annual payments. The fee is monthly, not per session: once the month has started it is not reduced for public holidays, school holidays, facility closures provided for in this annex or the participant’s absences. The number of sessions in each month varies according to the calendar and the group’s day of the week. When the place is confirmed, the family is told the number of sessions planned for their group over the season and the total price, so that the variation between groups is known before contracting.

I.6 · Pro-rata for joining part-way through a month

Anyone joining once the month has started pays only for the weeks of class remaining, in any month of the season, December included. One week is worth the monthly fee ÷ 4, and the amount never exceeds the full fee. For participants already registered the fee is fixed: December is paid in full.

The amount is the monthly fee ÷ 4 × the weeks remaining, rounded to the nearest multiple of €5 (ties rounded up). Example: for 2 h for children (€150 a month), 1 week is €40, 2 weeks €75, 3 weeks €115 and 4 weeks €150.

I.7 · Sibling discount

When two or more siblings are enrolled at the same time, they are ranked from highest to lowest monthly fee. The one with the highest fee pays 100%. The second pays 95% of their own fee. The third and any additional sibling pays 90% of their own fee, with the discount going no lower than that.

The discount is applied at the family’s request and takes effect from the date of the request. It has no retroactive effect: invoices already issued before that request are neither recalculated nor refunded.

The discount lasts only while the siblings are enrolled at the same time; if one withdraws, the discount for the remaining siblings is recalculated from the following month.

Courtesy classes. Echevarri Sports may offer courtesy make-up classes, subject to court and coach availability and at its sole discretion, without this changing the price, giving any right to make up absences or setting a precedent for future occasions.

II.3 · Reservation and payment of the remaining amount

The place is pre-reserved with a deposit equal to the price of a single day (€115) per participant and per week. Only full payment guarantees the place.

The remaining amount must be paid at least 7 calendar days before the start of the camp. If payment is not completed within that period, point 3.4 applies: the place may be released —including offering it to the waiting list—, the family loses the deposit and the amounts paid over and above it are refunded. The deposit is deducted in full from the total price.

II.4 · Changes of week or plan

They may be requested up to 7 calendar days before the start of the camp, subject to availability. Any difference in price is calculated on the price fixed for the registration.

II.6 · Water activities

Taking part in activities involving swimming pools, water areas or other aquatic environments is subject to Echevarri Sports’ internal safety protocols. The family acknowledges that:

  • Aquatic environments carry inherent risks even under supervision.
  • Access to water areas may be limited, adapted or restricted depending on group dynamics and operating conditions.
  • The use of flotation devices is determined by the organisation according to the activity, the area and the supervision structure, and is not automatically guaranteed for all participants.

Echevarri Sports may limit or deny access to water activities whenever it considers it necessary for safety reasons. It is compulsory to state on registration whether the participant can swim, in accordance with point 2.5.

II.7 · Groups
